Trademark scholars' roundtable: reading list

I spent much of the weekend at the fabulous Trademark Scholars’ Roundtable on use as a mark, hosted by the University of Iowa College of Law, a consistently stimulating discussion. Mark Janis, and Kati Jumper on the administrative side, did an incredible job despite substantial trouble in transportation.

A reading list:

  1. Mark P. McKenna, Trademark Use and the Problem of Source in Trademark Law
  2. Dinwoodie/Janis and Dogan/Lemley Colloquy, 92 Iowa Law Review 1597-1721 (2007)
  3. Stacey Dogan and Mark Lemley, The Trademark Use Requirement in Dilution Cases, Santa Clara Law Review (2008)
  4. William G. Barber, Dumping the “Designation of Source” Requirement from the TDRA: A Response to the Alleged “Trademark Use Requirement” in Dilution Cases, Santa Clara Law Review (2008)
  5. Eric Goldman, Online Word of Mouth and its Implications for Trademark Law, in Dinwoodie/Janis, Trademark Law and Theory (Elgar 2008) ch. 15
  6. Margreth Barrett, Internet Trademark Suits and the Demise of “Trademark Use”, 39 U.C. Davis L. Rev. 371 (2006).
  7. Verimark (Pty.) Ltd. v. BMW (AG), [2007] SCA 53, 61 (Republic South Africa, Court of Appeal, May 17, 2007)
  8. Case C48/05, Adam Opel v. Autec AG, (ECJ 2007), 2007 WL 187793
  9. Kolotex Glo Austl. Pty. Ltd. v. Sara Lee Personal Prods., (1993) 26 I.P.R. 1 (Austl.)

I will type up my notes and post them soon.
